We are thrilled to be a part of the Constitution Review Conference taking place today, May 26, 2025, and continuing tomorrow, May 27, 2025, at the Mount Soche Hotel in Blantyre. This pivotal gathering, held under the theme “Reflections on Three Decades of the Constitution of the Republic of Malawi,” brings together legal experts, scholars, civil society leaders, and government representatives to reflect on the progress and challenges faced since the adoption of the country’s democratic constitution in 1994.

As Malawi marks over 30 years under its Republican Constitution, this conference provides a timely opportunity to interrogate critical constitutional issues, explore areas requiring reform, and renew national commitment to the values of democracy, human rights, and the rule of law.

CHeRA is proud to contribute to this national dialogue. On Tuesday, May 27, 2025, we will present a thought-provoking paper titled “The Constitutional Dilemma on Lesbians, Gays, Bisexuals, Transgender, and Intersex Rights in Malawi.” The paper is authored by our Executive Director Aniz Mitha, alongside renowned human rights advocates Gift Trapence and Bernard William Mbalati. It aims to unpack the complex intersection between constitutional protections, international human rights obligations, and the lived realities of LGBTI individuals in Malawi.

We recognize that discussions surrounding LGBTI rights remain sensitive, yet they are necessary for fostering an inclusive constitutional framework that upholds the dignity and rights of all citizens. Our presentation will provide legal insight, human rights analysis, and reflections on how Malawi’s Constitution can evolve to better serve every Malawian, regardless of identity.
